2. Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information.

2.1 Contact and Identity Information

We may collect your name, email address, phone number, mailing address, home address, date of birth, driver’s licence information, government-issued identification details, and other information required to verify your identity, complete a transaction, arrange a test drive, process a delivery, or comply with legal and regulatory obligations.

If you request financing, pre-qualification, payment estimates, affordability estimates, credit-related services, or a full finance application, we may collect personal and financial information such as:

  • name, address, date of birth, phone number, and email;
  • employment status, employer name, occupation, time employed, and income information;

2.7 Sensitive or High-Risk Information

Some information collected for financing, identity verification, fraud prevention, or vehicle purchase purposes may be sensitive. We limit the collection, use, disclosure, and retention of this information to what is reasonably necessary for the identified purpose, legal compliance, security, fraud prevention, or transaction completion.

We may use personal information for the following purposes:

  • to respond to inquiries and provide customer service;

4. Financing Pre-Qualification and Credit Services

Planet Motors may provide access to financing pre-qualification tools, payment-estimate tools, affordability tools, credit application tools, lender-submission tools, and related finance technology services.

Pre-qualification is not a credit approval, pre-approval, loan offer, or guarantee of financing. A pre-qualification result is an estimate or preliminary eligibility indication only.

Final approval, interest rate, term, monthly payment, down payment, vehicle eligibility, lender conditions, and funding are subject to lender review, verified information, selected vehicle, credit profile, applicable taxes and fees, and completion of a full finance application or other lender-required documents.

5. Soft Credit Inquiries and Hard Credit Inquiries

With your express consent, Planet Motors or our authorized financing, credit bureau, lender, or technology partners may perform a soft credit inquiry to provide a financing pre-qualification, affordability estimate, payment estimate, or related financing option.

A soft credit inquiry does not affect your credit score.

If you choose to proceed with a full finance application, lender review, credit approval, loan contract, lease contract, or final financing process, a hard credit inquiry may be required. A hard credit inquiry may affect your credit score.

We will seek consent before collecting, using, or disclosing personal information for credit-related purposes, including a soft credit inquiry or full finance application.

6. Consent

We collect, use, and disclose personal information with your consent, unless otherwise permitted or required by law. Consent may be express or implied depending on the circumstances and sensitivity of the information. For sensitive information, financing information, identity verification, credit bureau access, lender submission, or marketing communications, we will seek express consent where required.

Consent may be collected through a checkbox, form submission, digital signature, signed document, recorded verbal consent, email confirmation, SMS confirmation, account action, or another recorded method.

We may retain proof of consent, including:

  • date and time of consent;
  • IP address;
  • user agent and device information;
  • page URL;
  • form version;
  • privacy policy version;
  • disclosure version;
  • checkbox status;
  • consent language shown to you;
  • vendor, lender, bureau, or tool involved;
  • transaction or lead reference number.

You may withdraw consent at any time, subject to legal, contractual, lender, regulatory, accounting, tax, fraud-prevention, dispute-resolution, and recordkeeping limits. Withdrawing consent may limit our ability to provide certain services, including financing, delivery, warranty administration, vehicle purchase, trade-in, deposit, customer support, or legal/regulatory assistance.

7. Information Sharing and Disclosure

We do not sell your personal information.

We may share personal information with the following categories of recipients where reasonably necessary for the purposes described in this Privacy Policy.

7.1 Financing, Credit Bureau, and Lender Partners

We may share personal and credit-related information with consumer credit reporting agencies, including Equifax Canada and/or TransUnion Canada where applicable, as well as banks, credit unions, auto finance companies, lender networks, finance platforms, identity verification providers, fraud-prevention providers, and technology partners that help us provide financing pre-qualification, credit application, payment estimate, affordability estimate, and vehicle purchase services.

7.6 Legal, Regulatory, Compliance, and Safety Disclosures

We may disclose personal information where permitted or required by law, including to courts, regulators, government authorities, law enforcement, OMVIC, tax authorities, lawyers, insurers, auditors, collection agencies, fraud-prevention bodies, and other parties where necessary to protect our rights, comply with legal obligations, enforce agreements, investigate fraud, respond to claims, or protect safety.

7.7 Business Transactions

If Planet Motors is involved in a merger, acquisition, financing, reorganization, asset sale, business sale, or similar transaction, personal information may be disclosed to prospective or actual parties and advisors, subject to confidentiality and legal requirements.

8. Cookies, Pixels, Analytics, and Tracking Technologies

We may send marketing emails, text messages, calls, or other commercial electronic messages only where permitted by law and, where required, with your consent. Marketing consent is separate from consent required to process a vehicle purchase, financing request, appointment, delivery, warranty, guarantee, or customer-service matter.

You may unsubscribe from marketing communications at any time by using the unsubscribe link, replying STOP where available, updating your preferences, or contacting us. Even if you unsubscribe from marketing communications, we may still send transactional, service, legal, safety, warranty, financing, delivery, account, or purchase-related communications where permitted by law.

10. Automated Processing and Financing Tools

Some financing pre-qualification tools, affordability tools, fraud-prevention tools, payment-estimate tools, or lender platforms may use automated processing to help estimate financing eligibility, affordability, loan amount, payment range, fraud risk, identity verification status, or related financing options.

Any pre-qualification result is not final approval and is not a guarantee of financing.

Where required by applicable law, you may request more information about the factors used in an automated decision and may request human review.

11. Processing and Storage Outside Canada

Some of our service providers, technology platforms, hosting providers, payment processors, analytics providers, CRM systems, communication tools, financing platforms, advertising platforms, security tools, support providers, and other vendors may process or store personal information outside Ontario or outside Canada, including in the United States or other jurisdictions.

Information processed or stored outside Canada may be subject to the laws of those jurisdictions, including lawful access by courts, governments, regulators, law enforcement, or national security authorities.

We use reasonable physical, administrative, contractual, and technical safeguards designed to protect personal information against unauthorized access, use, disclosure, copying, modification, loss, theft, and misuse. These safeguards may include TLS/SSL encryption, access controls and role-based permissions, secure payment processing, employee confidentiality and privacy training, vendor due diligence, fraud-prevention tools, security monitoring, audit logs, private or restricted storage for sensitive documents, data minimization and retention controls, and error monitoring with sensitive-data redaction where available.

No system is completely secure. We cannot guarantee that personal information will never be accessed, used, or disclosed without authorization.

13. Retention of Personal Information

We retain personal information only as long as reasonably necessary for the purposes for which it was collected, or as required or permitted by law. Vehicle purchase and transaction records may be retained for at least seven years or longer where required for legal, tax, OMVIC, accounting, warranty, lender, fraud-prevention, or dispute-resolution purposes.

When information is no longer required, we will delete, anonymize, or securely dispose of it, subject to legal and operational requirements.
