These Terms of Service (“Terms”) govern your access to and use of the Planet Motors website, online tools, vehicle shopping experience, reservation tools, financing tools, trade-in tools, communications, and related services operated by Planet Motors Inc. (“Planet Motors,” “we,” “our,” or “us”).
By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use our website or services.

1. Agreement to Terms
By accessing our website, browsing inventory, submitting a form, booking an appointment, placing a deposit, requesting financing, requesting pre-qualification, using a trade-in tool, communicating with us, or purchasing a vehicle, you agree to be bound by these Terms and any additional terms, disclosures, consents, purchase agreements, finance agreements, warranty terms, guarantee terms, or other documents that apply to your transaction.
If there is a conflict between these Terms and a signed purchase agreement, finance agreement, warranty agreement, lender agreement, or transaction-specific document, the transaction-specific document will apply to that transaction to the extent of the conflict.
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection, motor vehicle dealer, privacy, credit, or other laws.
2. Eligibility
To use our services, you must:
- be at least 18 years old;
- have legal capacity to enter into binding agreements;
- provide accurate and complete information;
- comply with applicable laws;
- hold a valid driver’s licence where required for test drives, delivery, financing, insurance, registration, or vehicle purchase;
- be legally able to purchase, finance, insure, register, sell, or trade a vehicle in Canada.
We may refuse service, cancel a reservation, cancel a deposit, or decline to proceed with a transaction where information is incomplete, inaccurate, suspicious, fraudulent, unverifiable, or where required by law, lender requirements, fraud-prevention requirements, or dealership policy.
3. Vehicle Information, Availability, and Website Content
We make reasonable efforts to ensure vehicle listings, pricing, mileage, options, photos, descriptions, availability, inspection details, battery-health information, warranty information, and other website content are accurate and current.
However, errors, omissions, delays, prior sales, data-feed issues, third-party information errors, photo errors, pricing errors, and availability changes may occur.
Vehicles displayed on our website are subject to prior sale and may be sold, reserved, removed, repriced, or made unavailable at any time without notice.
Planet Motors is not bound by errors in pricing, specifications, descriptions, photos, options, mileage, payments, financing terms, availability, or other listing information. We may correct errors and may refuse, cancel, or reverse a transaction based on incorrect information, with a refund of any deposit paid where applicable.
4. Pricing and OMVIC All-In Pricing
All advertised vehicle prices are in Canadian dollars and include all mandatory fees and charges Planet Motors intends to collect, except HST and licensing, unless otherwise clearly stated.
Licensing refers to the actual cost of vehicle registration and plates. HST and licensing are extra unless specifically stated otherwise.
Optional products, protection plans, extended warranties, insurance products, accessories, aftermarket items, delivery outside included areas, financing charges, lender fees, and customer-selected add-ons are not included unless specifically stated in writing.
Advertised prices are subject to change without notice before a binding purchase agreement is signed. If a website, inventory feed, third-party marketplace, advertisement, or vehicle listing contains an error, Planet Motors may correct the error and is not obligated to complete a transaction based on incorrect information.
5. Taxes, Licensing, Registration, and Fees
Unless otherwise stated in writing, the customer is responsible for applicable taxes, licensing, registration, insurance, financing charges, lender fees, delivery charges, optional products, and other amounts required to complete the transaction. Vehicle registration, licensing, insurance, and approval requirements may vary by province or territory.
6. Deposits and Vehicle Reservations
A $250 refundable depositmay be used to temporarily reserve a vehicle while the customer completes required steps such as identification, financing, documentation, inspection, trade-in verification, insurance, and purchase paperwork. The deposit is refundable within 48 hours of placement.
A deposit does not guarantee financing approval, vehicle availability, final price, trade-in value, delivery date, or completion of a purchase until all required agreements are signed and accepted.
Planet Motors may cancel a reservation and refund a deposit where a transaction cannot proceed due to financing decline, fraud concern, documentation issue, prior sale, pricing error, vehicle availability issue, lender issue, legal requirement, or other reasonable business reason.
7. Financing, Pre-Qualification, and Credit Applications
Planet Motors may provide access to financing pre-qualification tools, payment-estimate tools, affordability tools, credit application tools, lender-submission tools, and related finance technology services.
Pre-qualification is not a credit approval, pre-approval, loan offer, or guarantee of financing. A pre-qualification result is a preliminary estimate or eligibility indication only. Final approval, interest rate, loan term, monthly payment, down payment, vehicle eligibility, lender conditions, and funding are subject to lender review, verified information, selected vehicle, credit profile, applicable taxes and fees, and completion of a full finance application or other lender-required documents.
With your express consent, a soft credit inquiry may be used for pre-qualification or affordability-estimate purposes. A soft credit inquiry does not affect your credit score.
If you proceed with a full finance application, lender review, credit approval, loan contract, lease contract, or final financing process, a hard credit inquiry may be required. A hard credit inquiry may affect your credit score.
Planet Motors is not a bank, credit union, or credit bureau. Financing may be arranged through third-party lenders, finance companies, credit unions, banks, finance platforms, and technology partners.
8. Finance Advertising and Rates
Any advertised financing rate, payment, term, or cost of borrowing is subject to approved credit, lender approval, selected vehicle, down payment, verified information, credit profile, vehicle eligibility, lender conditions, and applicable laws.
Unless a full representative example is shown, any rate or payment shown should be treated as an estimate only. Your actual rate, payment, term, cost of borrowing, total amount payable, required down payment, and approval status may differ.
Financing terms, rates, payments, and approvals are subject to lender review, approved credit, selected vehicle, down payment, verified information, and lender conditions. Any payment or rate shown on the website is an estimate only unless confirmed in a signed finance agreement.
Planet Motors may update, remove, or correct financing offers at any time before a binding purchase or finance agreement is signed.
9. Credit Consent and Privacy
By submitting a financing pre-qualification request, credit application, payment estimate request, or related finance form, you agree that your information may be collected, used, and disclosed as described in our Privacy Policy and any applicable Credit Consent or Financing Pre-Qualification Disclosure shown to you.
You may be required to provide separate consent before a soft credit inquiry, hard credit inquiry, lender submission, identity verification, or full finance application.
Planet Motors may retain proof of consent, including date, time, IP address, user agent, page URL, checkbox status, disclosure version, form version, vendor/tool used, and related transaction records.
10. Trade-In and Selling Your Vehicle
If you request a trade-in value, appraisal, or offer to sell your vehicle to Planet Motors, you agree to provide accurate and complete information about the vehicle, including ownership, liens, accident history, condition, mileage, modifications, damage, warning lights, mechanical issues, title status, keys, tires, accessories, and service history.
Any online trade-in value, instant estimate, or preliminary offer is not final and may be adjusted after physical inspection, documentation review, lien verification, vehicle history review, market review, or discovery of inaccurate or incomplete information.
You must have legal authority to sell or trade the vehicle and must provide clear title or acceptable lien payout information.
11. Delivery and Pickup
Planet Motors may offer vehicle pickup or delivery options depending on location, vehicle, transaction type, customer eligibility, scheduling, weather, carrier availability, documentation, insurance, payment status, lender status, and other operational factors. Delivery times are estimates only and are not guaranteed.
You are responsible for being available to inspect and accept the vehicle at delivery or pickup unless otherwise agreed in writing. Risk of loss may transfer upon delivery acceptance, pickup acceptance, or as otherwise stated in the signed purchase documents.
Delivery outside included areas may involve additional charges. Unless otherwise required by law or unless the return is due to a material misrepresentation by Planet Motors, return transportation, shipping, inspection, reconditioning, and related costs may be the customer’s responsibility as described in the applicable guarantee terms.
12. 10-Day Satisfaction Guarantee
Planet Motors offers a voluntary 10-Day Satisfaction Guarantee on eligible transactions, subject to separate written terms, conditions, exclusions, inspection requirements, kilometre limits, return process, deductions, fees, and eligibility requirements published on that page.
The 10-Day Satisfaction Guarantee is not a statutory cooling-off period. Not all transactions, vehicles, customers, financing arrangements, delivery locations, or circumstances may qualify. Customers should review the full 10-Day Satisfaction Guarantee Terms & Conditions before purchase.
13. Vehicle Condition, Inspection, History, and EV Battery Information
Planet Motors makes reasonable efforts to inspect vehicles and provide available information such as inspection details, vehicle history reports, condition information, and battery-health information where applicable.
Used vehicles are not new vehicles. Normal wear, cosmetic imperfections, prior repairs, maintenance history, tire wear, brake wear, software status, charging behaviour, battery degradation, and manufacturer warranty status may vary by vehicle.
Vehicle history reports, inspection reports, battery reports, and third-party data are provided for transparency but may contain information supplied by third parties. Planet Motors is not responsible for third-party reporting errors or omissions.
Electric vehicles may include EV Battery Health Certification or battery-health information where available. Any battery-health representation, warranty, or coverage applies only if expressly stated in writing for the specific vehicle. Do not rely on the word “certified,” “inspected,” or “battery-certified” as creating a warranty beyond what is expressly stated in writing.
14. Warranties, Protection Plans, and Optional Products
Vehicles may include the balance of manufacturer warranty where applicable, limited dealer warranty where expressly stated, or optional warranty/protection products available for purchase. Any warranty, protection plan, service contract, insurance product, or optional product is subject to its own written terms, provider rules, eligibility, exclusions, deductibles, claim process, and coverage limits. Optional products are not mandatory unless specifically required by a lender and clearly disclosed.
15. Accounts, Passwords, and Website Access
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately if you suspect unauthorized access or misuse. We may suspend, restrict, or terminate website access, account access, form access, or tool access where we suspect fraud, abuse, scraping, security risk, unauthorized use, inaccurate information, or violation of these Terms.
16. Electronic Communications
By contacting Planet Motors, submitting forms, creating an account, requesting financing, placing a deposit, booking an appointment, purchasing a vehicle, or otherwise interacting with us electronically, you consent to receive transactional and service-related communications from us.
Marketing communications are separate. We will send commercial electronic messages only where permitted by law and, where required, with your consent. You may unsubscribe from marketing communications at any time.
17. Prohibited Conduct
You agree not to:
- provide false, inaccurate, incomplete, or misleading information;
- impersonate another person;
- submit fraudulent financing, identity, trade-in, or payment information;
- use our website or services for unlawful purposes;
- interfere with website operation, security, or availability;
- scrape, crawl, harvest, copy, data mine, or extract website data without written permission;
- attempt to bypass security controls, bot detection, CAPTCHAs, access controls, rate limits, or authentication systems;
- upload malicious code, malware, or harmful content;
- reverse engineer, copy, or exploit website functionality;
- violate applicable laws or third-party rights.
18. Website Availability and Third-Party Services
We do not guarantee that our website, online tools, forms, payment tools, financing tools, inventory feeds, chat tools, or third-party integrations will always be available, uninterrupted, secure, or error-free. We are not responsible for downtime, errors, delays, decisions, reports, approvals, declines, or service failures caused by third-party providers.
19. Limitation of Liability
To the maximum extent permitted by law, Planet Motors Inc., its directors, officers, employees, contractors, agents, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of opportunity, loss of data, loss of goodwill, financing decline, vehicle unavailability, website downtime, or third-party service issues.
This limitation does not limit any non-waivable rights you may have under applicable law or any rights expressly provided in a signed vehicle purchase agreement, finance agreement, warranty agreement, or other transaction-specific document.
20. Indemnity
You agree to indemnify and hold harmless Planet Motors Inc. from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms, false or misleading information you provide, misuse of our website or services, fraud, unauthorized activity, unlawful conduct, or violation of third-party rights.
21. Dispute Resolution, OMVIC, and Consumer Rights
If you have a concern, please contact Planet Motors first so we can attempt to resolve it.
For vehicle-related complaints, customers may contact OMVIC at 1-800-943-6002.
Nothing in these Terms prevents you from contacting OMVIC, a regulator, a court, a consumer protection authority, the Office of the Privacy Commissioner of Canada, or another authority where you have a legal right to do so.
Subject to applicable law and any non-waivable consumer rights, disputes relating to these Terms or our services will be governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
22. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
24. No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes in our website, services, laws, technology, business practices, financing tools, vehicle sales process, or dealership operations. When we update these Terms, we will update the “Last updated” date and version number. Material changes may be communicated through our website, email, account notice, form notice, or another reasonable method. Your continued use of our website or services after changes are posted means you accept the updated Terms.
